Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about August 28, 2003, CMJ Construction had employees exposed to the
hazard of being
struck and crushed by inadequately braced and secured wood trusses.
Feasible means of
abatement could have been achieved by following the truss manufacturer
guidance incorporated
in the following document prepared by the Truss Plate Institute and
provided to the employer.
This document was entitled, HIB-91, Summary Sheet Commentary and
Recommendations for
Handling, Installing & Bracing Metal Plate Connected Wood Trusses, and it
recommended the
following bracing:
1) Top chord lateral and diagonal bracing for pitched trusses
2) Bottom chord lateral and diagonal bracing, and
3) Web member plane bracing.
