Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about November 12, 2003 employees were exposed to crushing injures from an air powered chain hoist being used to lift loads greater than its rated capacity. The air powered chain hoist located in the store managers office was being used to lift 55 gallon drums of "BD- 20" and "Windshield Washer Premix". The weight of these drums, which is greater than 460 pounds, exceeds the 300 pound capacity of the air powered chain hoist. In accordance with American Society of Mechanical Engineers ASME B30.16-2003, para. 16-3.2.1, "The hoist shall not be loaded in excess of its rated load except for test purposes as provided in para. 16.2.2.2 or for planned engineered lifts as provided in para. 16-3.2.2." Among other methods, one feasible and acceptable method to correct this hazard is to replace the current hoist with one of sufficient capacity to lift the 55 gallon drums safely.
