Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On January 12, 2004 an employee was exposed to fall hazards while riding the forks of the below-the-hook pallet lifter attached to the boom truck from the roof of a two-story single- family dwelling to the ground below. The employee was exposed to a fall of approximately 20'-0". Among other methods, one feasible and acceptable abatement method to correct this hazard is to: a)ensure the operator does not ride, or allow others to ride, loads or the lifting device in accordance with ASME B30.20-2003, American National Standard for Below-the-Hook Lifting Devices, Section 20-1.4.3.
