Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On September 9, 2004, at the construction site located at 2413 North Neil Street, Champaign, Illinois 61820, employees were exposed to fall hazards while working from the platform resting on the forks of the rough terrain forklift because: a)one side and one end of the personnel platform was missing the required straining means, such as, but not limited to, a railing, chain or cable and employees were not wearing harnesses and lanyards. The employees were exposed to a fall of approximately 28'-2-1/4". b)an air hose was used as a straining means on one side and one end of the personnel platform and employees were not wearing harnesses and lanyards. The employees were exposed to a fall of approximately 28'-2-1/4". Among other methods, one feasible and acceptable abatement method to correct this hazard is to: a)be certain that required straining means such as railings, chains, cable, body belt(s) with lanyard(s), etc. are in place and properly used in accordance with ASME B56.6-2002, American National Safety Standard for Rough Terrain Forklift Trucks.
