Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crush by hazard:
Employee was exposed to a crush by hazard due to operating a forklift
which was
in need of repairs on the steering mechanism,back-up alarm not operable and
employee not trained to operate a forklift.
This occurred on October 02,2002 at the Taft Gin yard. Among other methods
for abatement, one feasible and acceptable abatements to correct this
hazard
would be to do the following as recommended by OSHA standard 29 CFR
1910.178(l) to train fork lift operators and 29 CFR 1910.178(p)(1) to
withdraw
from service powered industrial equipment identified as needing repairs.
American National Standard ANSI B56.1-1975 makes the following
recommendations: Section 424 Warning Device, Section 602 Operator Training
and Section 607 Operator Care of The Truck.
