furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to a fall hazard:
Employees were using a JLG 40HA 40 Foot Manlift Unit A646 Serial Number
24803 to install new pipe racking at the Formosa Plastics worksite.
a) The boom would malfunction and stop responding to the controls during
the raising
or lowering of the basket. The employer failed to follow the manufacture's
warning,
which required the employer to "shut down a malfunctioning unit until
repaired."
b) The lowest hinge on the aerial lift's basket door was broken from the
frame of the
basket. The door is part of the basket's guard rail system.
Among other methods, one feasible and acceptable method of abatement would
be to
remove the Manlift from the service and request a serviceable Manlift Unit
from the
rental company.
