Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to head injuries from soft drink
cans that were falling from an overhead conveyor.
a. On or about February 20, 2003, employees were exposed to head injuries
from soft drink cans that were
being transported overhead via a conveyor. When the conveyor line became
congested from too many cans,
the cans would fall below and could strike the employees head.
Among other methods, one feasible and acceptable method to correct this
hazard is to comply with American
National Institute, ANSI B20.1, 1972, Section 5.14.2.2, Crossovers, and
ensure that all conveyors crossing
over working areas, are equipped with spill guards.d
