Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazard of being crushed by forklift during rollover: (a) On 12/16/02, employees were observed operating forklifts and they were not wearing the manufacturers' installed seat belts, exposing them to the hazard of being ejected from the forklift and/or crushed in a rollover. One feasible and acceptable method to abate this hazard is to train employees in accordance with the forklift manufacturers' operating instruction manual which require the employees to wear and/or use the installed seatbelts.
