Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of truck tipover. a) Entire facility- Employees operating powered industrial trucks, including Hyster J30B, equipped with operator restraint systems were not required to utilize the restraints when moving loads. One method of abatement is to ensure restraints are used in accordance with ASME B56.1-2000, Section 5.3.19. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).s
