Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazards of overturning a forklift that was not equipped
with an operator restraint
system.
The Clark Model C500-120 forklift, forklift number 23, was not equipped
with a seat
belt or other operator restraint system, exposing employees to the hazard
of being
crushed by the overhead guard during an accident in which the forklift
overturns.
Among other methods, an acceptable and feasible means of abatement would
be:
1.Retrofit the forklift with an appropriate seat belt or other operator
restraint
system.
2.Take the Clark model C500-120 forklift #23, out of service and replace
the lift with another that is equipped with the appropriate operator
restraint.
