Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from moving vehicles due to employees riding on the tailgate of pickup trucks: On 5/16/06, two employees were riding on the tailgate of a pickup truck. Two employees were sitting on the tailgate and one employee fell off after the pickup truck accelerated. One employee incurred fatal injury. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to provide employee with an approved seat and seat restraint system: (a) Thomas Cove, 100 Middessa Drive, Odessa, DE 19730 - On 5/16/06 two employees were riding/sitting on the tailgate of a pick up truck, one employee fell as the pick up truck accelerated, hitting his head on the black top, resulting in fatal injury. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
