Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

furnish employment and a place of employment which are free from
recognized hazards that are
causing or likely to cause death or serious physical harm to employees
exposed to hazards of
operating powered industrial trucks.  The employer violated this section
of the Act on or about
March 13, 2003, at various locations; in the dry bean area, a powered
industrial truck operator
was allowed to operate a propane fueled Nissan industrial truck (ID#130)
without utilizing its
seatbelt.  This condition exposed the operator to crushing injuries in the
event the truck would
tip over during operation; In warehouse number 2, a powered industrial
truck operator was
allowed to operate a propane fueled Nissan industrial truck (ID#97)
without utilizing its seatbelt.

Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to ensure that operators of powered industrial trucks utilize
the seatbelt
provided by the manufacturer.

exposed to the recognized hazard of being struck by falling portions of
the hoisted load(s) on
overhead hoists.  The employer violated this section of the Act on or
about March 13, 2003, at
various locations: The Dayton 2 ton electric overhead hoist located along
the north side of
warehouse #2, had a in-operable latch on its load hook, and the hoist was
not inspected daily
to ensure all safety devices were functioning appropriately.  This hoist
was
utilized to lift and
maneuver batteries for powered industrial trucks.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to provide a load hook with an operable latch, in accordance
with Paragraph
16-2.1.2.10(d) of the American National Standards Institute (ANSI)
B30.16-1973,
Overhead Hoists.

correct this
hazard is to determine the load rating capacity of the overhead structure
on which the
hoist is mounted, in accordance with Paragraph 16-2.1.3.6 of the American
National
Standards Institute (ANSI) B30.16-1973, Overhead Hoists.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to perform frequent inspections (daily) of all safety devices to
determine
malfunctions, in accordance with Paragraph 16-2.2.1.2(b) of the American
National
Standards Institute (ANSI) B30.16-1973, Overhead Hoists.
b)The P & H 250 pound capacity, electric overhead hoist located in the
maintenance shop did not have inspections conducted to ensure safe
operating
conditions.  This hoist was utilized for material handling.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to determine the load rating capacity of the overhead structure
