Section 5(a)(1) of the Occupational Safety and health Act of 1970: On or about June 9, 2003,the employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the recognized hazard of being crushed/struck by equipment/falling loads when the crane operator was instructed to continue with pile connection operations prior to repair of the crane's anti-two block device. a) Among other methods, one method of abatement is to ensure that crane operator shall be responsible for those operations under his direct control. Whenever there is any doubt as to safety, the operator shall have the authority to stop and refuse to handle loads until safety has been assured in accordance with section 5-3.1.3d USA Standard, Safety Code for Cranes, Derricks, Hoist, Jacks and Slings, USAS B30.5- 1968, Crawler, Locomotive and Truck Cranes. DISCLAIMERS: 1)You are not limited to the abatement methods suggested above. 2)The methods explained are general and may not be effective in all cases. 3)The employer is responsible for selecting and carrying out an appropriate method.
