Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazardous material of an unknown substance leaking from a box with a hazardous label warning sticker during the process of package handling at the United Parcel Service center located at 2600 Booth St., Monroe, LA. The package was not properly routed from the loading belt by a designated responder after management was aware of the leaking package and allowed the package to be reintroduced to the loading belt where the contents spilled onto the belt and other packages. a) Among other methods, one feasable method of abatement is to enforce the rules and procedures which are consistant with the Corporate Wide Settlement Agreement between United Parcel Service and the United States Department of Labor which defines United Parcel Services's responsibility in dealing with emergency response to damaged packages that can present exposure conditions to employees.
