Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being burned or asphyxiated by
releases of
pressurized gases, such as natural gas, and being burned by the release of
hot water and oil:
(a) Employees performing maintenance on the treaters at the Land Tronson
Central Tank
Battery Site; Medicine Lake, Montana on or about February 28, 2003 and at
times prior
thereto were exposed to the hazard of being burned by the release of hot
water and oil.
(b) Employees performing maintenance on the treaters at the Land Tronson
Central Tank
Battery Site; Medicine Lake, Montana on or about February 28, 2003 and at
times
prior
thereto were exposed to the hazard of being burned or asphyxiated by the
release of
pressurized gases such as natural gas.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to develop and implement a hazardous energy control program in
accordance with, a)
ANSI Z.244.1-1982, Lockout/Tagout of energy sources minimun safety
requirements. b) 29
CFR 1910.147(c)(4)(ii)(A-D). c) API RP 54, August 1999, Recommended
Practice for
Occupational Safety for oil and gas well drilling and servicing
operations. The lockout
procedures shall include, but not limited to, the following essential
elements.
1. a) Specific procedural steps for shutting down, isolating, blocking,
and securing machines
or equipment to control hazardous energy.
b) Specific procedural steps for the placement, removal and transfer of
lockout
devices or
tagout devices and the responsibility for them.
c) Specific requirements for testing a machine or equipment to determine
and verify the
effectiveness of the lockout devices, tagout devices, and other energy
control measures.
2. Employee training.
3. Periodic inspection of the energy control procedures at least annually
to ensure that the
procedures are being followed.
