Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a. On or about December 31, 2002, at the above addressed jobsite, the Marklift CH44C 7258-ML extensible boom aerial lift had the midrails removed. Among feasible means of abatement would be to comply with the American National Standards Institute(ANSI) A92.5-1980, Standard for Boom Supported Elevated Platforms Design Considerations for Platform which explains that the work platform shall be provided with a guardrail or other structure 42 inches high around its upper periphery, with a midrail, and with toeboards not less than 4 inches high.s
