Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. On or about December 1, 2003, at the above addressed jobsite, an employee performing carpentry work from a platform on the forks of a Manitou, Model Number MTV 1130L, rough terrain forklift truck was exposed to fall hazards in that an operator was not present to operate the controls and/or the platform was not equipped with controls. One feasible and acceptable abatement method, among others, would be to comply with the ASME/ANSI B56.6-2002 Safety Standard for Rough Terrain forklift trucks, which requires a trained operator to be in position to control the rough terrain forklift truck.ft
