Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were casuing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck or crushed into the
rear Hopper of the
Refuse Collector:
a.  On or about March 5, 2003, employees were exposed to the hazard of
being struck or
crushed by a dislodged and swing dumpster during the process of emptying
it's contents into
the rear Hopper of the Refuse Collector in that the locking device
(Trunion locking devices)
for the container was not engaged on the refuse truck, allowing the
dumpster to become
dislodged during this operation.
One feasible and acceptable abatement method, among others, to correct
this hazard is to use
the container's locking device on the rear of the refuse truck during the
emptying
operation
and to develop a written procedure, as well as training and enforcement,
for employees using
the Trunion locking devices as referenced by the American National
Standards Institute
(ANSI) Z245.1-1999, entitled "Mobile Wastes and Recyclable Materials
Collection,
Transportation, and Compaction Equipment-Safety Requirements", paragraph
6.2.5.7.4(a),
(the cited written procedures) and paragraph 9.3.1.1 (the cited training).
