Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
to each of his employees employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of falling from an
elevation while
working from a wood pallet raised on the forks of a fork lift truck.
a.Outside the front of the retail establishment - On or about June 23,
2003, employee(s) required
to perform maintenance and repair on an electric sign used a wood pallet
on the raised forks of
a fork lift truck as a work platform. The pallet did not have a guardrail
to protect the
employee(s) from falling, nor were the employee(s) tied off. The pallet
was not secured to the
forks of the forklift truck to provide stability, and to prevent it from
moving on the forks or
tilting from side to side. Employee(s) were working approximately twelve
to thirteen feet above
the cement sidewalk below.Thereby employees were exposed to the recognized
hazards
associated with falls from elevated unsecured work areas.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
1. With the approval of the fork lift truck manufacturer, the use of a
commercially manufactured
safety work platform or basket that is specifically designed for use on
forklifts, personnel and
meets the specifications of American National Standards Institute (ANSI)/
American Society of
Mechanical Engineers (ASME) B56.1-1969 or current update to be used as
stipulated in
paragraph 4.17, Elevating Personnel.
2. With the approval of the forklift manufacturer, the in-house
fabrication ( certified by a
professional engineer) of a proper safety work platform meeting the
specifications of American
National Institute (ANSI)/ American Society of Mechanical Engineers (ASME)
B56.1-1969 or
update to be used as stipulated in paragraph 4.17, Elevating Personnel
