Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck or crushed into the
rear hopper of the
refuse collector:
a.  On or about August 4, 2003, employees were exposed to the hazard of
being struck or
crushed by a dislodged and swing dumpster during the process of emptying
contents into the
rear hopper of the refuse collector.  The container locking devices
(trunion locking devices)
were not operable on refuse truck #2514.
One feasible and acceptable abatement method, among others, to correct
this hazard is to
1)develop and implement a program of inspection to ensure that hooks and
latches are in
good repair in accordance with American National Standards Institute
(ANSI)
Z245.1-1999,
entitled "Mobile Wastes and Recyclable Materials Collection,
Transportation, and
Compaction Equipment-Safety Requirements", paragraph 6.2.5.7.4(a),
(written procedures)
and paragraph 9.3.1.1 (training) 2) Perform daily and monthly inspections
of the hook and
latch as suggested in the Leach 2R II Packmaster Service Manual , Section
4, Preventive
Maintenance.
