Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards and other serious hazards from the operator leaving the position to control the rough terrain forklift truck: a. On or about July 14, 2003, at the addressed jobsite, employees performing masonry work from a Lull RT rough terrain forklift truck were exposed to fall and struck by hazards due to the absence of an operator in position to operate the controls and/or the platform was not equipped with controls. Among other feasible means of abatement would be to comply with the ASME/ANSI B56.6a- 2002, for all rough terrain forklift trucks and have an operator present and remain at the position of control at all times.l
