Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical ham to employees in that employees were exposed to the hazards of falls. a) On or about September 24, 2003 the Genie personnel lift (serial #1463-4657) was not in safe operative condition and not removed from service with defective chains and outriggers in the event the chains and outriggers failed the employees and lift could fall and cause serious injury to the employees. One feasible and acceptable abatement method, among others, to correct this hazard is to remove defective equipment from service and to repair or replace the unit. As referenced by the American National Standards Institute (ANSI) ANSI/SIA A92.3-1990, entitled manually propelled elevated aerial platforms manual of responsibilities. Paragraph 7.3 (the cited equipment not in paper operating conditions shall be immediately removed from service until repaired), thereby exposing the employees to the hazards of fall
