Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a.  On or about November 21, 2003, at the above addressed jobsite, an
employee was
performing masonry work on the South side of the building from a "Man"
basket attached to the
forks of a rough terrain forklift truck.  The employee was using the
midrail of the platform to
achieve additional reach, thereby exposing the employee to falls of
approximately ten (10) feet.
One feasible and acceptable abatement method, among others, would be to
comply with the
American National Standards Institute/American Society of Mechanical
Engineers (ANSI/ASME
B56.6-1992) Safety Standard for Rough Terrain Forklift Trucks, which
prohibits the use of
railings, planks, ladders, etc., on the platform for purpose of achieving
additional reach or
