Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Establishment - The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls from job made personnel platforms and hazards of crushing due to forklift overturn and the lack of seatbelt use. (1) Employees operating powered industrial trucks are not required to wear the operator restraint devices (seatbelts) provided on the trucks exposing employees to hazards related to truck overturn. (2) Employees moving and storing product such as transmissions and performing other elevated work on platforms attached to the forks of operating powered industrial trucks are exposed to fall hazards due to the lack of adequate guardrail systems on the platforms. Among other methods, one feasible and acceptable method of abatement is: 1.Provide a standard personnel lift with the required safety features. 2.Require employees to wear safety harnesses and lanyards of the proper type and length while working from unguarded elevated locations. 3.Provide railings, or the equivalent of sufficient height for access areas to the platform. 4.Follow the safety procedures provided for in ANSI B56.1-2000 for elevating work platforms and operator restraint systems. 5.Verify that the platforms are constructed and used in accordance with ANSI B56.1-2000 which states a guardrail shall have a height of no less than 36 inches or more than 42 inches. 6.Provide and require use of seat belts when operating powered industrial trucks. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
