Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
Pony Express Green House - The employer did not furnish employment and a
place of
employment which were free from recognized hazards that were causing or
likely to
cause death or serious physical harm to employees in that employees were
exposed to the
hazard of being struck by materials falling from unsecured storage racks:
1) Employee(s) working near the storage racks were exposed to the
potential of
boxes weighing from 10 to 50 pounds falling on them following the racks
being
struck or pushed by powered industrial trucks.  If these vehicles were to
strike
the unsecured racks, the racks could move and then the materials could be
knocked off, falling and injuring the employees.
Among other methods, one feasible and acceptable method of abatement is:
1. Secure the racks to prevent them from moving if struck by any materials
handling
vehicles.
2. Redesign the layout of the racks to preclude them from being in an area
where they
are in a "stand alone" position.
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements
or monitoring results, and photographs or videos which you believe will be
helpful. The
abatement certification sheet is enclosed with the citations.
