Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Throughout the facilities in the vicinity of the job site located at 150 S. Main St., Fremont, NE - The employer failed to furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being crushed by the fork lift being operated without seat belts. Employees face the potential of being thrown from a fork truck due to the lack of restraint device usage observed on the job site. Among other methods, one feasible and acceptable method to control the hazard is to: a) Develop and implement written procedures as per ASME Standard B56.1-2000, requiring operators of powered industrial trucks to utilize restraint devices provided when operating the vehicles. b) Develop and implement a disciplinary action and procedures to ensure that employees wear restraint devices while operating these vehicles. c) Review and audit the company's training program and trainers to ensure that information being presented is true and factual as per the latest regulatory directives and reflects OSHA policy and generally accepted industry practices such as ASME Standard B56.1-2000. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.ion
