Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that:
a)Employees were exposed to the hazard of being struck-by or crushed under
loads through
the use of alloy steel chain slings connected to the padeye(s) on the
Caterpillar 936F
Wheel Loader bucket.  The manufacturer placed the padeyes on the bucket to
lift the
bucket only during the construction of the front end loader itself.  The
manufacturer did
not and does not intend that the vehicle be used to lift anything other
than material within
the bucket.  If lifting is required, the manufacturer has lifting
attachments to fit on the
arms of the loader.  Load charts are given only for material lifted in a
bucket, and the
Section on "Operating Techniques" (page 46) of the "Operation and
Maintenance
Manual" show safe operations with the bucket or with optional fitted
lifting devices.
There are no instructions on the use of alloyed steel chain lings for
lifting or otherwise.
One feasible and acceptable method, among other methods, to correct this
hazard is to
have the operators trained in the limitations of the machine and to only
lift loads in the
bucket, as shown in The Operation Section, Operating Techniques( page 46)
of the
"Operation and Maintenance Manual" for the Caterpillar Mod.936F Wheel
