Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer allowed a Maintenance Worker to stand on the top cap of a fiberglass step ladder. The employee was exposed to an 8-foot fall hazard. a) At EURO BAKE, two management officials, the Production Manager and Maintenance Supervisor observed an employee standing on the top cap of an 8-foot fiberglass step ladder and failed to counsel the employee on safe workplace practices or take disciplinary action against the employee for a violation of the ladder manufacturer's caution warning on or about 5, 6 & 8 December 2002. ABATEMENT VERIFICATION REQUIRED
