Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)On or about 1/21/03 in the Packaging area; Hyster forklift #81144351481
did not
have a seat belt.  Employees operating powered industrial trucks without
being
equipped and using seat belts were exposed to the hazard of injury from
tip over
accidents which seat belts are designed to address.  Seat belts in
forklifts are a
component part of an operator restraint system that is designed to reduced
the
incidence and severity of injuries to the operator in the event of a tip
over
accident, a hazard to which forklift trucks are particularly susceptible,
and the
failure to have and wear the seat belt increases the risk of injury to the
operator.
Among other methods, a feasible and acceptable method to correct the
hazard is
to provide a seat belt recognized by the requirements of ANSI B56.1
consensus
standards for powered industrial trucks.
