Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls from elevation: (a) A fall from elevation hazard of approximately 30 feet (9m) when accessing boat without fall protection. Employees ride the forks of a forklifts to put on boat covers when retrieving boats from the elevated parking area. A safety platform is used to access the elevated areas at other times, but the guardrails are not a 42 inch nominal height, there was no midrail or toeboard. In addition there was an access opening on the platform that did not have a locking gate opening inward, or other suitable enclosure. Violations were observed on or about 01/27/03. Abatement notes: Among others, one suitable method for abating this hazardous condition is: 1) Utilize only platforms designed for use in elevating personnel with forklifts. These platforms must meet the requirement set forth in ANSI/ASME B56.1-1993. 2. Train all employees about the hazard of falls associated with improper elevating methods, and the proper application and use of safety platforms and personnel fall protection.
