Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a falling hazard and/or a crushing hazard: (a) On or about 06/03/03 an operator was not wearing his seat belts that were provided on the caterpillar powered industrial truck he was riding. Warning decals were posted on the overhead protection stating the requirement of the use of seatbelts for safety in the event of a tipping hazard. Among other methods one feasible and acceptable method to correct the hazard is to enforce the wearing of seat belts while operating powered industrial trucks in accordance with ASME B56.1-1993.
