General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) the hazards of being crushed or struck by an aerial lift and or the light pole being hoisted from the aerial lift basket. The aerial lift was used as a crane to hoist a light pole using the guardrail of the basket as an attachment point while the operator was in the basket. This could have resulted in the tipping of the aerial lift and or the light pole becoming detached from the guardrail which was not designed or approved as an attachment point. The warning sign inside the aerial lift basket clearly states that it is not to be used as a crane and that ropes or chains are not to be attached to the guardrail. Among other methods, recognized and feasible means to correct this hazard include, but are not limited to using a crane designed to hoist or lift materials.
