Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) At the work site, employees were exposed to an asphyxiation hazard
while working
inside manholes (confined spaces)for 3 to 4 hours a day. The employer did
not insure the safety
of his employees from the recognized hazards of confined spaces by not
having an effective
confined space program. A feasible and acceptable method of abatement to
this hazard is to
develop and implement an effective confined space program which includes
but not limited to:
acquiring oxygen deficient and gas metering instruments to test for
hazardous atmospheres and
training management and employees on the use and employment of such
instruments, providing
rescue equipment such as safety harnesses and lanyards with lifting
tri-pods,
providing
respirators and/or breathing apparatuses and other personal protective
equipment for the
conditions that are present, attendant rescue and first aid training, and
maintaining written
procedures for the program and certification of all trained employees.
