Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a) On or about 08/20/03 an employee fell from a pallet being elevated by a forklift. The pallet/ scaffold platform was not attached to the forks of the lifting device and did not have standard guardrails. The employee was working at a height of approximately 13 feet. Among other methods, one feasible and acceptable abatement method to correct the fall hazards would be to use a man basket approved by the forklift manufacturer. This basket must be securely mounted to the forklift and have standard guardrails.r.
