Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck-by falling concrete pipe:
(a)  On or about 10/07/03, a Catapillar 215 Excavator was lifting 2000
lb(900kg)
concrete pipe with a steel chain sling,  which was not approved for
overhead lifting.  The rated
capacity was not known and the chain could break or it could slip off of
the load as it did in this
case.  A wire rope choker sling is commonly used for this purpose and was
put into service
replacing the chain before work was continued.  The choker sling will not
break or slip off while
lifting the concrete pipe.  On or about 10/07/03, the concrete pipe was
being placed into a 6.5
foot (2 m) deep trench at the construction site.  The steel chain was
approximately 20 feet (6 m)
long and 3/8 inch (0.95cm) diameter.
Applicable regulations for this type of chain:  ANSI B30.9-1971, Table 1
" *Other grades of
proof tested steel chain include Proof Coil, BBB Coil and Hi-Test Chain.
These grades are not
recommended for overhead lifting and therefore are not covered by this
code.").  Among other
methods, one feasible and acceptable abatement method to correct this
hazard is to follow the
appropriate manufacturer's specifications for lifting devices.  The
following standards should be
followed:  ASME B30.20-1999, BELOW-THE-HOOK LIFTING DEVICES Chapter
20-1.2.1
Markings (a) Rated Load Marking.  The rated load of the lifting device
shall be marked on the
main structure where it is visible... (b) Identification. A nameplate or
other permanent marking
shall be affixed displaying the following information: (1) manufacturer's
name and address; (2)
serial number; (3) lifter weight, if over 100 lbs (45 kg), (4) rated load.
ANSI Standard, Slings,
B30.9-1971 Section 9-1.2.1 Rated capacity (working load limit) for Alloy
Steel Chain Slings,
Section 9-1.3.1 Welded alloy steel chain slings shall have permanently
affixed durable
identification stating size, grade, rated capacity and sling manufacture.
