Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falls in that:
a) The employer did not ensure that the Genie S-65 Boom lift was operated
in accordance
with the American National Standard Institute 92.5 standard (ANSI) 92.5)
which states in
Section 7.9 that "The aerial platform shall be used in accordance with
this standard.  The user
shall ensure that before each movement of the aerial platform, if
repositioning the platform, that
the operator shall ensure the aerial platform is operated on a surface
within the limits specified
by the manufacturer. The manufacturer's operating instructions state; do
not raise or extend the
boom unless the machine is on a firm level surface.
On or about April 7, 2004, the employer allowed the Genie S-65 Boom lift
to
be operated while
on a slope surface at the Northwest corner of the building which resulted
in the fatal accident
when the boom lift tipped over. This condition was exacerbated by the wet
ground conditions
from recent rain. Among other methods, recognized and feasible means to
correct this hazard
include, but are not limited to prohibiting the use of the Genie S-65 Boom
lift on a sloped or
unlevel surface.
