SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that the operator of a JCB Brand forklift, Serial Number SLP53000E077653, not at the controls while 2 employees were elevated in a work basket in excess of 12 feet high at peak of building, constituted a hazard of the lift shifting, or of the employees falling, or of the lift being struck by objects or other hazards and no way for the employees to get down. A feasible and useful method to correct this hazard, among others, is to have the operator remain at the controls while the employees are in an elevated basket.
