SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that the operator of an Allis-Chalmers brand forklift, not at the controls while one employee was elevated in a work basket in excess of 13 feet high at rear of building, constituted a hazard of the lift shifting, or of the employees falling, or of the lift being struck by objects or other hazards, and no way for the employee to get down. A feasible and useful method, among others, to correct this hazard, is to have the operator remain at the controls while the employee is in an elevated basket.
