Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazards:
(a)  Location - Establishment
On or about 6/13/03, some metal racks, holding multiple pallets containing
approximately 300 to 3000 pounds of ceramic tile, pails of adhesives, and
bags of grout,
had structural damage, exposing the employees to hazard(s) of being struck
or crushed
by falling material.
Among other methods, feasible means of abatement methods include:
(1)  To repair or replace all damaged metal storage racks as per
manufacturer's
specifications.
(2)  To develop a maintenance program designed to recognize weakness in
the rack
system, in order to prevent a structural collapse.
(3)  To follow rack manufacturer recommendations regarding proper storage
and use.
(4)  To instruct the employees of the approved rack load capacities,
enabling them to
verify the maximum amount of material that could be safely stored.

employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an injury from employees not being restrained in a
forklift truck in case of
tipping and/or rollover:
(a)  Location - Warehouse
On or about 6/13/03, employees operating forklifts were not wearing seat
belts that were
available, exposing them to potential crushing hazards.
One feasible means of abatement to correct this hazard is to wear seat
belts that are
provided.
(b)  Location - Warehouse
On or about 6/13/03, an employee was operating a forklift that was missing
the seat belt
although it had the seat belt hardware.  The Toyota forklift was used for
moving vinyl
flooring.
One feasible means of abatement to correct this hazard is to have the
manufacturer or
their representative reinstall the missing seat belt.  Also, the employer
could modify the
daily inspection of forklifts to include a seat belt check so that missing
or damaged seat
belts will be reported in a timely manner.
