Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling while climbing out of and into a scissor lift while the lift was elevated. (a) Location - 45 Crosby Drive, Bedford, Ma: On or about 08/21/2003, an employee was exposed to the hazard of falling while climbing out of and into a scissor lift while it was elevated. Among other means, feasible means of abatement would be to read and follow the manufacturer's operational manual in which it states "do not climb in and out of the lift while the lift is elevated".
