Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees,
without life vests or any protective equipment, were exposed to the hazard
of falling into water
containing protruding metal sheathing:
(a) Location - Shawsheen River / Route 3, Bedford, MA:
On or about 10/09/03, employees, without life vests or any protective
equipment, were
exposed to the hazard of falling into water containing protruding metal
sheathing while
using a manmade raft to cross the Shawsheen River.
Among other methods, feasible and acceptable, to correct this hazard,
include but are not
limited to: a) provide a proper skiff that meets or exceeds the Coast
Guards definition
for a safe water buoyant skiff or b) install a stable walkway over the
river.
