recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an injury from employees not being restrained in a
forklift truck in case of
tipping and/or rollover:
(a)  Location - Loading Yard
On or about 12/5/03, employees were not using the supplied seat belt while
operating a
powered industrial truck and the seat belt was caked with cement dust,
buckled behind
the seat and not available for easy access.
One feasible means of abatement to correct this hazard is to have the
manufacturer or
their representative repair or replace the inoperative seat belt.  Also,
enforce the
employer's Mobile Equipment Pre-Shift Inspection Policy for
pre-inspection, completing
inspection sheets, and tagging out defective equipment.
