Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and/or crushing hazards. (a) Location - shipping dock On or about February 23, 2004, an employee was injured while backing out of a delivery truck trailer as the delivery truck started to pull away from the shipping dock. The forklift truck fell backwards off of the trailer approximately three to four feet onto the pavement below. A feasible means of abatement would be for the employer to implement a wheel chocking policy whereby a delivery vehicle is not to pull away from the dock until the employer checks that the vehicle is safe to proceed and removes the chocks. The employer could also implement a policy whereby the driver of the truck is required to wait on the shipping dock with company employees until the trailer is loaded or unloaded and is ready to leave the dock.
