Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing or being struck: a) Location - Production: On or about August 10, 2004, a Budgit One Ton (2,000 pounds) electric overhead underslung hoist was connected to a Budgit One-Half Ton (1,000 pounds) trolley to lift and move a machine weighing approximately 4,300 pounds. The hoist, trolley, and machine fell and resulted in severe lacerations to the forearm and hand of an employee. One feasible means of abatement, among others, is to ensure that all components of an overhead underslung hoist system (beam, trolley, chain hoist, etc.) are matched for load rating and inspected in accordance with ASME B30.16-2003.
