Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of: (a) Location - Outside of Building: On or about 4/12/04, employees were exposed to glass falling up to six stories from broken windows. Among other means, feasible means of abatement would be to: 1. Provide overhead protection from the falling glass at all locations where employees are exposed; or 2. Replace the windows in the building.
