Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to: Hazards created by the use of elevated work platforms which were not used in accordance with the acceptable requirements of the American National Standard for Rough Terrain Forklift Trucks, ASME B56.6-1992. A trained operator was not in position to control the rough terrain forklift. This condition existed when an employee was working out of an supported platform and no operator was the controls and/or the wheels were not blocked. Among other methods, one feasible and acceptable abatement method to correct this hazard is: Comply with ANSE B56.6-1992: Ensure that if an employee is working on a supported platform, an operator is at the controls and/or the wheels are blocked.
