General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment or a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not institute a medical surveillance program for all employees who were or could be exposed to crystalline silica at or above the PEL: Workers involved in the Handworking Area were exposed to respirable silica dust on January 29, 2004, without the protection of an effective medical monitoring program to protect workers against the early onset of silicosis. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to identify exposed employees, use of an appropriate medical questionnaire to identify employees with symptoms of silicosis and referral of symptomatic employees to physicians who specialize in occupational or respiratory medicine for appropriate medical treatment.
