Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical physical harm to employees in that employees were exposed to a fall of 11 feet to the ground from the top of steel storage tanks, "frac tank": (a) On 1/14/03, employees were observed working from the tops of steel tanks containing flammable methanol. Employees were working outside of the installed guardrails on these tanks and they were observed stepping from one tank to another and the distance between the two tanks were 18 to 30 inches apart, exposing them to fall hazards of 11 feet. Among others, one feasible and acceptable method to correct this hazard is to provide training to employees which require them to stay within the guardrails when working on these tanks andto implement a policy that calls for the employees to come down and use the tank stairway to access the topof the tanks, or install a ramp or walkway with guardrails between the two tanks.n
