North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: a)facility - employees were allowed to use hoists #3 and #1 with hooks that were missing the safety latch. (Ref. ASME B30.10-1998, para.10-1.2.1.2(C)(5) and ASME B30.16-1998, para 16-1.2.9) b)facility - Hoist #1, a BUDGIT HOIST 1 Ton electric chain hoist was installed on an underslung monorail which was not marked for the appropriate load ratings and visible from the ground or floor. (Ref. ASME B30.16-1998, para. 16.1.1.1) c)facility - where the hoist load attachment chain (roller chain) was not inspected on a monthly basis on Hoist #1, a BUDGIT HOIST 1 Ton electric chain hoist installed on an underslung monorail. (Ref. ASME B30.16-1998, Table 2 and para. 16-2.1.2 and 16-2.6.1) d)facility - where Hoist #1, a BUDGIT HOIST 1 Ton electric chain hoist installed on an underslung monorail, had not been inspected in past 12 months. (Ref. ASME B30.16-1998, Table 2 and para. 16-2.1.3 and 16-2.6.1) e)facility - required inspections were not performed and records of hook inspections were not accomplished/maintained on hoists #3 and #1. (Ref.
