North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of 6 feet 8 inches (Ref. 1910.25(d)(viii) and (xi)): a)plant, wet cast - in the big diameter area, an employee was observed straddling a Werner fiberglass, 8-step ladder, standing on the next to top step and the next to top bar of the reverse side, at a height of 6 feet 8 inches. The employee was assisting with the positioning of the concrete bucket. b)plant, wet cast - in the big diameter area, a Werner fiberglass, 8-step ladder in use by an employee, was observed to have a damaged rung on the non-step side. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT EACH OF THESE HAZARDS IS: A)to use a longer step ladder when employees need to assist with positioning the concrete bucket. B)to conduct periodic ladder inspections and tag out any ladders that are found to have defects.
